Terms of service

These terms are the agreement between you and Query Logic Solutions Limited for using Buzzly. By creating an account, or by taking part in a session, you accept them.

1.The agreement

These terms apply to everyone who uses Buzzly: organisers, who have an account, and participants, who join sessions without one.

If you create an account on behalf of an organisation, you confirm that you are allowed to accept these terms for it, and “you” includes that organisation. You must be at least 18 to create an account.

Our privacy policy explains how we handle personal information, and forms part of these terms.

2.The service

Buzzly lets organisers run live quizzes, polls, word clouds and Q&A, which participants answer from their own devices.

We improve the service over time, which means features can change. If we remove something important to a paid plan, we will tell you in advance.

3.Your account

Give accurate information when you sign up and keep it up to date. Keep your password secret. You are responsible for what happens in your account, including what the members you invite do. Tell us straight away if you think someone else has used it.

4.Your content

What you create — decks, questions, images, and the results of your sessions — stays yours.

You allow us to store, copy and display it only as needed to run the service for you: for example, to show your slides on screens and phones in your sessions, and to keep backups.

You confirm that you have the right to use everything you upload, and that it doesn't break the law or anyone else's rights.

5.Running sessions

As an organiser, you are responsible for the sessions you run and for what you do with the results. That includes:

  • telling participants how their answers will be used, and getting any consent the law requires — particularly for children;
  • moderating the questions you approve for the big screen;
  • handling participants' requests about their information, with our help where you need it.

6.Acceptable use

Organisers and participants must not use Buzzly to:

  • break the law, or help anyone else to;
  • post content that is hateful, harassing, threatening, sexually explicit, or that exploits children;
  • infringe anyone's copyright, trademarks or other rights;
  • upload malware, or try to reach systems or information you aren't allowed to;
  • get around plan limits, rate limits or other protections, or overload the service;
  • copy the service, or collect information from it by automated means;
  • resell the service or offer it under another brand without our written agreement.

We may remove content or suspend access that breaks these rules.

7.Plans and payments

  • The Free plan costs nothing and allows up to 50 participants in a session. We may change what it includes.
  • Paid plans cost what is shown when you buy them, and are paid in advance for 30 days (monthly) or 365 days (yearly). An event pass is paid once for 7 days.
  • Card payments renew automatically at the end of each period until you turn off auto-renew on your billing page. M-Pesa payments buy one period at a time. An event pass never renews.
  • If a period ends without payment, your plan keeps working for 3 days. After that, your organisation can't make or change decks or start sessions until you renew or choose another plan, which can be the Free plan. Nothing you have created is deleted, and your past results stay in your account.
  • When you change plans, the unused days of your current plan carry over to the new one.
  • Except where the law requires otherwise, payments are not refundable. If something went wrong with a payment, contact us and we will look into it.
  • If we change the price of a plan you pay for, we will tell you in advance, and the new price applies from your next renewal.

8.Availability

We work to keep Buzzly running and fast, but we can't promise it will always be available or free of errors, and we sometimes need to take it offline for maintenance. A live session also depends on the venue's network and on participants' devices, which we don't control. Guaranteed availability is offered only in a separate written agreement.

9.Our service

The software, design and brand of Buzzly belong to Query Logic Solutions Limited. These terms let you use the service; they don't transfer any of it to you. Don't copy, modify or reverse-engineer it, except where the law allows. If you send us feedback, we may use it without owing you anything.

10.Ending the agreement

You can stop using Buzzly at any time, and ask us to close your account. Before it is closed, you can download your results, on plans that include exports, or ask us for a copy.

We may suspend or close an account that breaks these terms, or when the law requires us to. Where it is reasonable, we will warn you first and give you a chance to fix the problem.

11.Disclaimers

As far as the law allows, Buzzly is provided “as is”, without promises beyond those in these terms.

Quiz scores are timed by our servers, but participants' devices and networks still affect how quickly they can answer. Don't use Buzzly as the only basis for decisions that seriously affect people, such as exams or hiring.

12.Liability

As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue or data, and our total liability to you for any claim is limited to what you paid us in the 12 months before it arose.

Nothing in these terms limits liability that the law does not allow to be limited.

13.Changes to these terms

When we change these terms, we will update them here and change the date at the top. If a change is significant, we will tell account holders before it takes effect. If you keep using Buzzly after that, you accept the new terms.

14.Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.

15.Contact
